1. Acceptance of Terms

By accessing or using FileKit (“Service”), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Service Description

FileKit provides tools and workflows related to QR code generation, QR styling, account-based access, analytics features, and file-related functions such as upload, transformation, conversion, storage, and delivery.

Features may differ by product area, plan, or workflow and may change over time.

3. Eligibility and Accounts

You must be legally permitted to use the Service. If you create an account, you must provide accurate, current information and maintain the confidentiality of your credentials.

You are responsible for all activity occurring under your account unless prohibited by applicable law.

4. User Content and Processing Permission

You retain ownership of the files, content, links, QR payloads, and other material you upload, submit, convert, generate, or otherwise provide through the Service (“User Content”).

You grant FileKit a limited, non-exclusive, revocable right to host, copy, process, transform, transmit, store, display, and otherwise handle User Content solely as necessary to operate, secure, support, troubleshoot, and improve the Service, and to provide the requested output, delivery, or account function.

You represent that you have all rights, permissions, and lawful bases required to upload, convert, share, generate, transmit, or link the User Content.

5. File Conversion Terms

File conversion results depend on the file format, source file integrity, embedded features, software compatibility, and technical limitations of the conversion workflow.

  • Supported file types, supported formats, and file-size limits may change over time and may vary by workflow.
  • Conversion is provided on a best-effort basis and output quality may vary.
  • We do not guarantee that every file can be converted successfully or without layout, formatting, metadata, feature, or quality changes.
  • Corrupted, password-protected, malformed, unsupported, restricted, or unusually structured files may fail to convert.
  • You are responsible for ensuring you have the lawful right to upload and convert the files you submit.

6. QR Code Terms

QR performance may depend on device camera quality, scanner software, print quality, contrast, size, lighting conditions, destination availability, styling choices, and later modifications made by the user.

Styled QR codes may become less readable if configured with unsuitable visual settings, logos, colors, or dimensions. You are responsible for testing QR codes in your intended environment before relying on them.

7. Payment, Pricing, and Refunds

Pricing is displayed at checkout or within the relevant product flow. Taxes may apply where required. Payments may be processed by third-party providers.

Unless otherwise required by law, fees are generally non-refundable once the requested digital service has been initiated or delivered. A refund may be considered where required by mandatory law or where we determine that the paid service failed due to a fault attributable to FileKit.

Refunds are generally not available for issues caused by user error, unsupported inputs, malformed files, invalid destinations, user-provided unlawful content, or failures outside our reasonable control.

8. Consumer Information

If you use the Service as a consumer, mandatory consumer protection laws may apply and may override parts of these Terms where required.

Certain digital services may begin immediately after purchase or request. Where applicable and lawfully implemented, your statutory withdrawal right may be affected once performance begins, but only to the extent permitted by law and properly disclosed to you.

9. Acceptable Use

You agree not to misuse the Service or use it for unlawful, harmful, deceptive, or abusive purposes.

  • No infringement of copyright, trademark, privacy, publicity, trade secret, or other rights.
  • No phishing, credential theft, impersonation, fraud, or deceptive redirects.
  • No malware, exploit delivery, ransomware-related use, or other malicious payload distribution.
  • No unlawful surveillance, harassment, or illegal abuse of personal data.
  • No unlawful adult content, unlawful sharing, or content prohibited by applicable law.
  • No attempts to interfere with platform security, bypass limits, scrape restricted areas, or access systems without authorization.

We may remove content, disable access, or take enforcement action where we believe there is infringement, unlawful use, abuse, or other policy violation. Repeat violators may be suspended or terminated.

10. Availability and Delivery

We do not guarantee uninterrupted availability of the Service. The Service may be unavailable due to maintenance, updates, provider outages, abuse-prevention controls, legal compliance actions, or technical failures.

File delivery, email delivery, conversion completion, or QR availability may be delayed or fail due to third-party providers, destination issues, user configuration, security filtering, or circumstances beyond our reasonable control.

11. Intellectual Property

The term “QR Code” is a trademark of DENSO WAVE INCORPORATED. Except for User Content you own, the Service, including branding, software, design, text, graphics, and platform materials, is owned by FileKit or its licensors and protected by applicable law.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, and protect information.

13. Suspension, Termination, and Content Handling

We may suspend, restrict, or terminate access to the Service if we reasonably believe you violated these Terms, misused the Service, created risk or legal exposure, or if suspension is necessary for security, abuse prevention, legal compliance, or platform integrity.

After account closure or termination, access to stored files, converted outputs, generated QR content, analytics, or public links may end, be limited, or be removed according to the product workflow, operational needs, and our retention practices.

14. Liability and Disclaimers

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied.

To the maximum extent permitted by applicable law, FileKit is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunity, or business interruption arising from or related to the Service.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including where relevant for fraud, willful misconduct, or other non-excludable liability.

15. Changes to the Terms

We may update these Terms from time to time. Where changes are material, we may provide notice on this page, by email, or through the Service. Continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms, except where applicable law requires a different approach.

16. Governing Law and Disputes

These Terms are governed by the laws of Hungary and applicable European Union law, without regard to conflict of law rules.

If a dispute arises, we encourage you to contact us first to seek an informal resolution. Any disputes not resolved informally will be subject to the courts located in Budapest, Hungary, unless mandatory consumer protection law requires otherwise.
