Acceptance of Terms

By accessing or using FileKit QR Generator (“Service”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

Service Description

FileKit QR Generator provides tools to create QR codes and deliver the generated codes to your email address. The Service may include account features, payment processing, and analytics to improve performance.

Use of Service

  • You may generate QR codes for personal or business purposes only.
  • You must provide a valid, accurate email address to receive generated QR codes.
  • Each QR code costs €0.99. All payments are final and non-refundable except where required by law.
  • You are responsible for ensuring any content linked to your QR codes is lawful, does not infringe third-party rights, and is free of illegal, harmful, or deceptive material.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

Payment, Pricing, and Refunds

Pricing is displayed at checkout and may include applicable taxes. Payments are processed by a third-party payment provider. All sales are final and non-refundable except where mandatory consumer protection laws apply. If a refund is required by law, it will be issued to the original payment method.

Subscriptions and Cancellation

The Service is currently offered on a per-QR-code basis and does not require a subscription. If we introduce subscription plans, we will clearly disclose pricing, billing frequency, and cancellation options before you subscribe.

Usage Restrictions

You agree to use the Service only for lawful purposes and in compliance with these Terms. You must not misuse the Service or attempt to access it in an unauthorized manner.

Prohibited Use

You agree not to use the Service for any illegal or unauthorized purposes, including but not limited to:

  • Hosting, linking to, or distributing illegal content or content that infringes intellectual property or other rights.
  • Spamming, phishing, or impersonation, including collecting credentials or personal data unlawfully.
  • Generating QR codes for unlawful, harmful, deceptive, or fraudulent activities.
  • Interfering with the integrity or security of the Service or other users’ QR codes.

Data Provision Obligations

You must provide accurate, up-to-date information when using the Service, including a valid email address for delivery. You may only submit or link to content that you have the legal right to use and share. We may request clarification or proof of lawful use when necessary to comply with legal obligations.

Account Responsibilities

If you create an account, you are responsible for maintaining the security of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use.

Intellectual Property

The term “QR Code” is a trademark of DENSO WAVE INCORPORATED. All other content, graphics, code, and designs on FileKit are the property of FileKit or its licensors. You may not reproduce, distribute, or create derivative works without permission.

Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

Liability

To the fullest extent permitted by law, FileKit is not responsible for any direct, indirect, incidental, or consequential damages arising from your use of the Service. Use the Service at your own risk.

Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, either express or implied. We do not guarantee accuracy, reliability, or availability of the Service at all times.

Modifications to the Terms

We may modify these Terms at any time. We will notify you of material changes by posting a notice on this page and, where possible, by email or an in-product banner. Continued use of the Service after changes constitutes acceptance of the updated Terms. The latest version and effective date are always posted on this page.

Suspension and Termination

We may suspend or terminate access to the Service if we believe you have violated these Terms, misused the Service, or created risk or legal exposure for us. We may also restrict processing of data, limit access, or delay delivery of QR codes if we detect suspected abuse, phishing, spam, illegal or infringing content, or if required by law or a lawful request. We may also discontinue the Service with reasonable notice when feasible.

Termination

We may suspend or terminate access to the Service for any user violating these Terms, at our sole discretion, without notice and without liability.

Dispute Resolution and Jurisdiction

If a dispute arises, we encourage you to contact us first to seek an informal resolution. Any disputes not resolved informally will be subject to the exclusive jurisdiction of the courts located in Budapest, Hungary, unless mandatory consumer protection laws in your country require a different forum.

Governing Law

These Terms are governed by the laws of Hungary and applicable European Union law, without regard to conflict of law principles.
